Chubb CEO Evan Greenberg reportedly advised industry partners to reconsider their relationships with litigation funding firms, citing concerns over their impact on lawsuits and insurance costs. Christopher Bogart, CEO of litigation funding firm the Buford Capital, called Greenberg’s comments “inappropriate”, with other industry professionals offering similar comments. Sources from the insurance industry were asked to comment on the conflict, including Dr. Robert Hartwig, a professor at the University of South Carolina. When asked whether such remarks could be viewed as anti-competitive, Dr. Hartwig said he did not believe they rose to that level. He explained: “What litigation funding firms do is insert themselves between the insurer and the policyholder to profit from the loss of the policyholder. It’s a perversion of the foundational principle of insurable interest, which is legally required everywhere in the country.” To hear more of Hartwig’s perspective, as well as that of other interviewees, click here.
